Ty \u010dasto \u00fastily v pracovn\u00ed neschopnost, kter\u00e1 v pr\u016fm\u011bru<strong> <\/strong>trvala \u00factyhodn\u00fdch 58 dn\u00ed, ukazuj\u00ed data. Nejrizikov\u011bj\u0161\u00ed skupinou jsou lid\u00e9 pracuj\u00edc\u00ed v pr\u016fmyslu a ve v\u00fdrob\u011b, ale nehody se nevyh\u00fdbaj\u00ed ani kancel\u00e1\u0159\u00edm nebo \u0159idi\u010d\u016fm. V\u00edte, na co m\u00e1te v p\u0159\u00edpad\u011b pracovn\u00edho \u00farazu n\u00e1rok?<\/p>\n\n\n\n<p>\u010cesk\u00e1 legislativa (z\u00e1kon\u00edk pr\u00e1ce) definuje pracovn\u00ed \u00faraz jako nehodu, kter\u00e1 postihla zam\u011bstnance p\u0159i v\u00fdkonu pr\u00e1ce nebo v p\u0159\u00edm\u00e9 souvislosti s v\u00fdkonem pr\u00e1ce. Pracovn\u00ed \u00faraz m\u016f\u017ee zahrnovat fyzickou \u00fajmu nebo \u00famrt\u00ed.<\/p>\n\n\n\n<p>Zam\u011bstnanec, kter\u00fd utrp\u011bl pracovn\u00ed \u00faraz,<strong> m\u00e1 v z\u00e1kon\u011b zakotven\u00e1 pr\u00e1va<\/strong> na kompenzaci. Poj\u010fme se na stupn\u011b z\u00e1va\u017enosti \u00faraz\u016f a jejich n\u00e1hrady pod\u00edvat detailn\u011bji.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. Bolestn\u00e9<\/h2>\n\n\n\n<p>Z\u00e1kladn\u00ed n\u00e1hrada, kterou m\u016f\u017ee vym\u00e1hat oby\u010dejn\u011b ka\u017ed\u00fd, kdo utrp\u011bl pracovn\u00ed \u00faraz. Jeho smyslem je od\u010dinit v\u00e1\u0161 fyzick\u00fd nebo psychick\u00fd diskomfort.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-1 wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-background wp-element-button\" href=\"https:\/\/www.rixo.cz\/pojisteni-odpovednosti\/\" style=\"background-color:#1aaf5e\">Spo\u010d\u00edtat cenu poji\u0161t\u011bn\u00ed zam\u011bstnance<\/a><\/div>\n<\/div>\n\n\n\n<p><\/p>\n\n\n\n<p>Ka\u017ed\u00e9mu pracovn\u00edmu \u00farazu lze p\u0159i\u0159adit tabulkov\u00fd po\u010det bod\u016f podle tzv. <strong>bodov\u00e9ho hodnocen\u00ed \u00farazu<\/strong>. Finan\u010dn\u00ed ekvivalent jednoho bodu se v \u010dase m\u011bn\u00ed, ale v roce 2023 je stanoven na <strong>393,06 K\u010d.&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>Jak\u00e9 bodov\u00e9 a finan\u010dn\u00ed ohodnocen\u00ed u \u00faraz\u016f v pr\u00e1ci \u010dekat?&nbsp;<\/strong><\/p>\n\n\n\n<ul>\n<li>ztr\u00e1ta p\u0159edn\u00edho zubu v p\u0159edn\u00ed \u010d\u00e1sti chrupu (20 bod\u016f): 7 861 K\u010d<\/li>\n\n\n\n<li>vymknut\u00ed ramenn\u00edho kloubu (50 bod\u016f): 19 653 K\u010d<\/li>\n\n\n\n<li>poran\u011bn\u00ed zrakov\u00e9ho nervu (150 bod\u016f): 58 959 K\u010d<\/li>\n<\/ul>\n\n\n\n<p>O bolestn\u00e9 za\u017e\u00e1d\u00e1te po prvn\u00edm l\u00e9ka\u0159sk\u00e9m o\u0161et\u0159en\u00ed po pracovn\u00edm \u00farazu. Standardn\u011b \u017e\u00e1dost prob\u00edh\u00e1 v t\u011bchto kroc\u00edch:<\/p>\n\n\n\n<ol>\n<li>Bez zbyte\u010dn\u00e9ho odkladu nahl\u00e1s\u00edte pracovn\u00ed \u00faraz sv\u00e9mu zam\u011bstnavateli. Ten v\u00e1m d\u00e1 formul\u00e1\u0159 na od\u0161kodn\u011bn\u00ed bolestn\u00e9ho od poji\u0161\u0165ovny.<\/li>\n\n\n\n<li>V\u00e1\u0161 o\u0161et\u0159uj\u00edc\u00ed l\u00e9ka\u0159 formul\u00e1\u0159 vypln\u00ed. Vy ho p\u0159ed\u00e1te sv\u00e9mu zam\u011bstnavateli nebo ho za\u0161lete p\u0159\u00edmo poji\u0161\u0165ovn\u011b, u kter\u00e9 m\u00e1 v\u00e1\u0161 zam\u011bstnavatel poji\u0161t\u011bn\u00ed.<\/li>\n\n\n\n<li>Obdr\u017e\u00edte od\u0161kodn\u011bn\u00ed bolestn\u00e9ho.<\/li>\n<\/ol>\n\n\n\n<p>U v\u00fdpo\u010dtu bolestn\u00e9ho si dejte pozor na opomenut\u00ed n\u011bkter\u00e9ho ze zran\u011bn\u00ed a nep\u0159i\u010dten\u00ed bod\u016f za vykonan\u00e9 opera\u010dn\u00ed z\u00e1kroky.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. N\u00e1hrada za zt\u00ed\u017een\u00ed spole\u010densk\u00e9ho uplatn\u011bn\u00ed<\/h2>\n\n\n\n<p>Vy\u0161\u0161\u00ed stupe\u0148 od\u0161kodn\u011bn\u00ed pracovn\u00edho \u00farazu p\u0159edstavuje tzv. n\u00e1hrada za zt\u00ed\u017een\u00ed spole\u010densk\u00e9ho uplatn\u011bn\u00ed. Pak m\u00e1te n\u00e1rok na n\u00e1hradu ztr\u00e1ty na v\u00fdd\u011blku po celou dobu jej\u00edho trv\u00e1n\u00ed, dokud se nebudete moct vr\u00e1tit do pr\u00e1ce. Pokud by v\u00e1s pak \u00faraz omezoval a vy se v jeho d\u016fsledku dostali na h\u016f\u0159e placenou pozici, mus\u00ed v\u00e1m zam\u011bstnavatel dorovnat rozd\u00edl mezi d\u0159\u00edv\u011bj\u0161\u00edm a nov\u00fdm p\u0159\u00edjmem.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. N\u00e1hrada \u00fa\u010deln\u011b vynalo\u017een\u00fdch n\u00e1klad\u016f<\/h2>\n\n\n\n<p>Pokud va\u0161e l\u00e9\u010dba generuje n\u011bjak\u00e9 n\u00e1klady, m\u00e1te n\u00e1rok na jejich n\u00e1hradu. I s t\u00edm se m\u016f\u017eete obr\u00e1tit na zam\u011bstnavatele.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kdy na od\u0161kodn\u00e9 za pracovn\u00ed \u00faraz n\u00e1rok nem\u00e1te?<\/h2>\n\n\n\n<p>Do kategorie pracovn\u00edho \u00farazu ov\u0161em nespadaj\u00ed pat\u00e1lie, kter\u00e9:<\/p>\n\n\n\n<ul>\n<li>se v\u00e1m stanou mimo pracovn\u00ed dobu nebo pracovi\u0161t\u011b (pokud v\u00e1s po cest\u011b kousne pes, nejde o pracovn\u00ed \u00faraz)<\/li>\n\n\n\n<li>nesouvis\u00ed p\u0159\u00edmo se zam\u011bstn\u00e1n\u00edm (infarkt v pracovn\u00ed dob\u011b nen\u00ed pracovn\u00ed \u00faraz)<\/li>\n\n\n\n<li>si zp\u016fsob\u00edte u aktivit, kter\u00e9 nesouvis\u00ed s va\u0161\u00ed pracovn\u00ed n\u00e1pln\u00ed nebo u nich poru\u0161ujete bezpe\u010dnostn\u00ed pokyny<\/li>\n\n\n\n<li>si p\u0159ivod\u00edte \u00famysln\u011b nebo pod vlivem n\u00e1vykov\u00fdch l\u00e1tek<\/li>\n\n\n\n<li>se stanou osob\u00e1m pracuj\u00edc\u00edm na I\u010cO, pokud nemaj\u00ed speci\u00e1ln\u00ed p\u0159ipoji\u0161t\u011bn\u00ed<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Jak\u00fd je spr\u00e1vn\u00fd postup p\u0159i pracovn\u00edm \u00farazu<\/h2>\n\n\n\n<ol>\n<li>Zdokumentujte okolnosti vzniku \u00farazu,, fotografiemi \u010di zaji\u0161t\u011bn\u00edm sv\u011bdk\u016f (k t\u011bm mohou pat\u0159it i zdravotn\u00edci, pokud byl jejich z\u00e1sah pot\u0159eba).<\/li>\n\n\n\n<li>Pohl\u00eddejte si seps\u00e1n\u00ed z\u00e1znamu o pracovn\u00edm \u00farazu podepsan\u00fd zam\u011bstnavatelem.<\/li>\n\n\n\n<li>Nav\u0161tivte l\u00e9ka\u0159e, kter\u00fd v\u00e1m vystav\u00ed posudek s bodov\u00fdm hodnocen\u00edm \u00farazu.<\/li>\n\n\n\n<li>Dolo\u017ete v\u0161echny dokumenty (bodov\u00e9 hodnocen\u00ed, \u00fa\u010dtenky, l\u00e9ka\u0159sk\u00e9 zpr\u00e1vy apod.) a po\u017e\u00e1dejte zam\u011bstnavatele o vyplacen\u00ed od\u0161kodn\u011bn\u00ed.<\/li>\n\n\n\n<li>Pokud v\u00e1\u0161 zam\u011bsntavatel nechce v\u00e1\u0161 n\u00e1rok uznat, obra\u0165te se na odborn\u00edky z \u0159ad pr\u00e1vn\u00edk\u016f.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Co kdy\u017e se v\u00e1m stal \u00faraz mimo zam\u011bstn\u00e1n\u00ed, ale v pracovn\u00ed dob\u011b?<\/h2>\n\n\n\n<p>V takov\u00e9m p\u0159\u00edpad\u011b bude z\u00e1le\u017eet na detailech va\u0161eho konkr\u00e9tn\u00edho p\u0159\u00edpadu.<\/p>\n\n\n\n<p>\u00daraz se d\u00e1 klasifikovat jako pracovn\u00ed, pokud v\u00e1s sm\u016fla do\u017eene:<\/p>\n\n\n\n<ul>\n<li><strong>na slu\u017eebn\u00ed cest\u011b <\/strong>v aut\u011b, mezim\u011bstsk\u00e9m autobusu, vlaku nebo jin\u00e9m dopravn\u00edm prost\u0159edku. To se nevztahuje nap\u0159. na cestu na n\u00e1dra\u017e\u00ed v r\u00e1mci va\u0161eho m\u011bsta.<\/li>\n\n\n\n<li><strong>na home officu. <\/strong>Po\u0159\u00e1d plat\u00ed podm\u00ednka p\u0159\u00edm\u00e9 souvislosti s v\u00fdkonem pr\u00e1ce, tak\u017ee pokud si jako \u00fa\u010detn\u00ed sp\u00e1l\u00edte ruku u pe\u010den\u00ed b\u00e1bovky, o n\u00e1hradu ne\u017e\u00e1dejte.<\/li>\n\n\n\n<li><strong>na teambuildingu<\/strong>.
